Warranty Policy

Performance Brake Drum Co. LLC (“Seller”) warrants to the original purchaser (“Buyer”) that any product manufactured by Seller which is determined to be defective in material or workmanship shall, at Seller’s sole discretion, be repaired or replaced without charge. This remedy shall constitute Buyer’s sole and exclusive recourse for any liability of Seller under this warranty.

This warranty applies exclusively to products that fail under normal use and service as a direct result of defects in materials or workmanship. All claims are subject to inspection and verification by an authorized representative of Seller within a reasonable period following notice of the claim. No goods may be returned without Seller’s prior written authorization.

Seller’s liability to Buyer, or to any party claiming by or through Buyer, for any claim, demand, or loss arising from the products—or alleged to result from any act or omission of Seller, whether negligent or otherwise, in contract, or otherwise, including but not limited to failure to deliver, delay in delivery, or breach of warranty—shall in no event exceed the purchase price of the goods (or portion thereof) that are the subject of the claim. At Seller’s option, such liability may be discharged by replacement of the goods (or portion thereof).

Seller shall not, under any circumstances, be liable for bodily injury, death, or property damage arising from, related to, or in connection with the products, their manufacture, or their use. In no event shall Seller be liable for incidental or consequential damages, claims, lawsuits, or expenses of any kind arising out of any sale, contract, or transaction with Buyer.

This warranty shall not apply to, and Seller shall bear no liability for, failures or damages resulting from misuse, improper installation, unsuitable application, accident, fire, inadequate maintenance, or acts of God.

The foregoing constitutes the sole warranties provided by Seller. No other warranties, express or implied, are made. All implied warranties of merchantability and fitness for a particular purpose are expressly disclaimed and excluded.
